By downloading, installing, or using the Tonari mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our App.

These Terms constitute a legally binding agreement between you and Tonari regarding your use of our AI habit coaching service.

Description of Service

Tonari is an AI-powered habit tracking and coaching application that helps users build and maintain positive habits through:

• Personalized habit tracking and progress monitoring
• AI-generated motivational messages and coaching
• Smart notifications based on behavioral patterns
• Analytics and insights about your habit formation
• Goal setting and achievement tracking

Our AI coaching features are powered by Google's Gemini API to provide intelligent, contextual support.

Eligibility

You must be at least 13 years old to use Tonari. If you are between 13 and 18 years old, you may only use our service with parental or guardian consent. By using our App, you represent that you meet these age requirements.

Account Registration

Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• One person may not maintain multiple accounts

Account Responsibility

You are fully responsible for all activities that occur under your account. We are not liable for any loss or damage from unauthorized account use.

Subscription and Billing

Free and Premium Services

Tonari offers both free and premium subscription tiers. Premium features include unlimited habits, advanced AI coaching, detailed analytics, and priority support.

Billing Terms

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is processed through your device's app store (Apple App Store or Google Play)
• Prices may vary by region and are subject to applicable taxes
• Subscription renewal occurs automatically unless canceled

Cancellation and Refunds

• You may cancel your subscription at any time through your app store account
• Cancellation takes effect at the end of your current billing period
• Refunds are handled according to your app store's refund policy
• We do not provide direct refunds for app store purchases

Acceptable Use

You may use Tonari for personal habit tracking and self-improvement purposes in accordance with these Terms.

Prohibited Activities

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use automated tools to access or interact with our service
• Interfere with or disrupt the App's functionality
• Upload harmful, offensive, or inappropriate content
• Violate any applicable laws or regulations

AI Coaching and Content

AI-Generated Content

Our AI coaching features use Google's Gemini API to generate personalized messages and recommendations. While we strive for accuracy and helpfulness, AI-generated content should not be considered professional advice.

Limitations of AI Coaching

• AI coaching is for motivational and educational purposes only
• It does not replace professional medical, psychological, or therapeutic advice
• Always consult qualified professionals for serious health or mental health concerns
• AI responses may occasionally be inaccurate or inappropriate

User Responsibility

You are responsible for evaluating and acting upon AI-generated advice. Use your judgment and seek professional help when needed.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our App, you consent to our data practices as described in our Privacy Policy, including the processing of your data by third-party AI services.

Intellectual Property

Our Rights

Tonari and all related content, features, and functionality are owned by us and protected by intellectual property laws. This includes our app design, algorithms, and AI coaching methodologies.

Your Rights

You retain ownership of the personal data and habit information you provide. However, you grant us a license to use this data to provide and improve our services.

Feedback and Suggestions

Any feedback or suggestions you provide may be used by us without compensation or attribution.

Service Availability

Uptime and Maintenance

We strive to keep Tonari available 24/7, but we cannot guarantee uninterrupted service. We may perform maintenance, updates, or experience technical issues that temporarily affect availability.

Third-Party Dependencies

Our service relies on third-party providers including Supabase (data storage) and Google Gemini API (AI features). Service interruptions from these providers may affect our App's functionality.

Disclaimers and Limitations

Health and Wellness Disclaimer

Important: Tonari is a habit tracking tool and not a medical device or health service. Our App and AI coaching are not intended to diagnose, treat, cure, or prevent any condition. Always consult healthcare professionals for medical advice.

Service Disclaimer

Tonari is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Tonari, even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Tonari and its affiliates from any claims, damages, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

Termination

Termination by You

You may stop using our App and delete your account at any time. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

Termination by Us

We may terminate or suspend your access to Tonari immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination will remain in effect.

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Tonari is headquartered, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration rather than court proceedings, except where prohibited by law.

Changes to Terms

We may update these Terms periodically to reflect changes in our service or legal requirements. We will notify you of significant changes through the App or by email. Continued use of Tonari after changes become effective constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
